These Terms & Conditions (“Terms”) govern your access to and use of the Green Thumb Ranch website located at greenthumbranch.com (the “Site”), as well as your purchase of products, registration for events, booking of services, visits to our farm, and any other interactions with Green Thumb Ranch (“Green Thumb Ranch,” “we,” “us,” or “our”).

By using the Site, purchasing from us, booking with us, attending an event, visiting our farm, or otherwise interacting with our business, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase, book, or attend any services or events offered by us.

1. Use of the Site

You agree to use the Site only for lawful purposes and in a way that does not violate any applicable law, infringe the rights of others, or interfere with the operation of the Site or our business.

You may not misuse the Site, attempt unauthorized access to any portion of the Site, introduce malicious code, interfere with bookings or transactions, or use the Site in any way that could damage Green Thumb Ranch, its systems, or other users.

2. Privacy

Your use of the Site is also subject to our Privacy Policy. By using the Site or providing information to us, you agree to the collection and use of information as described in that policy.

3. Eligibility

By using the Site or making a purchase, booking, or reservation, you represent that you are at least 18 years old or are using the Site under the supervision of a parent or legal guardian.

4. Products and Services

Green Thumb Ranch may offer products and services including, without limitation, farm visits, events, animal appearances, animal experiences, roasted coffee, apparel, shirts, t-shirts, sweaters, eggs, fruits, vegetables, herbs, freeze-dried fruit, fruit trees, non-fruit trees, palms, coconut trees, nursery items, ranch goods, and animals.

Some products may be grown, raised, roasted, packed, produced, or supplied by Green Thumb Ranch, while others may be obtained from neighboring farms, partner farms, local growers, breeders, or agricultural partners. Availability, sourcing, pricing, varieties, colors, sizing, weight, appearance, and packaging may change without notice.

5. Appointments, Farm Visits, and Events

Farm visits, private bookings, event participation, and animal experiences are subject to availability, scheduling, weather, animal welfare, farm conditions, staffing, and our approval.

Visits may be by appointment only. No walk-ins are guaranteed to be accepted.

A booking, reservation, or ticket is not confirmed until accepted by us. We may require payment, a deposit, a signed agreement, a waiver, or additional information before confirming a booking or reservation.

We reserve the right to deny, limit, reschedule, postpone, or cancel any visit, reservation, event, booking, or service for safety reasons, weather, animal health or welfare, low attendance, emergencies, operational needs, force majeure, or any other reason we determine appropriate.

6. Payments and Pricing

All prices are subject to change without notice unless already confirmed by us in writing.

You agree to pay all charges associated with your order, booking, reservation, animal purchase, event, delivery, or pickup. Payments may be processed through a third-party payment provider.

If a payment is declined, reversed, disputed, or charged back, we may cancel the related order, booking, reservation, or event and pursue any available remedies.

7. Orders, Pickup, Delivery, and Shipping

We may offer pickup, local delivery, shipping, or other fulfillment methods depending on the product.

You are responsible for providing accurate billing, shipping, delivery, pickup, and contact information. We are not responsible for delays, failed deliveries, spoilage, loss, or additional costs caused by incorrect information, missed pickups, your unavailability, carrier delays, weather, or events beyond our control.

Unless otherwise stated in writing, risk of loss and responsibility for products pass to you upon pickup, delivery, or transfer to the carrier, as applicable.

8. Cancellations, Refunds, and Final Sales

Unless a different policy is posted for a specific item, event, or service or otherwise agreed by us in writing, all sales are final.

Deposits for events, animal bookings, private farm experiences, or reserved services may be non-refundable unless we state otherwise in writing.

Perishable goods, consumable goods, agricultural products, eggs, produce, herbs, coffee, freeze-dried fruit, plants, trees, nursery items, and animal sales are generally non-refundable and non-returnable unless required by law or expressly approved by us in writing.

If we cancel an event or service and do not reschedule it, any remedy, refund, credit, or transfer will be handled at our discretion unless otherwise required by law or stated in writing.

9. Apparel and Merchandise

Apparel and merchandise may vary slightly in color, size, material, print placement, or appearance.

Unless otherwise stated by us in writing, worn, washed, altered, customized, damaged, clearance, or final-sale merchandise is not eligible for return or exchange.

10. Food, Plant, and Agricultural Product Terms

You are responsible for reviewing any product descriptions, ingredient information, care instructions, storage instructions, handling directions, and plant guidance we provide.

We are not responsible for spoilage, quality changes, reduced shelf life, planting failure, transplant shock, weather damage, pests, disease, neglect, irrigation issues, soil conditions, or similar issues that occur after pickup, delivery, or transfer.

If you have dietary, allergy, agricultural, planting, or animal-care concerns, contact us before purchase.

11. Animal Sales and Transfer of Responsibility

Green Thumb Ranch may offer animals for sale that are raised on our farm or sourced through partner farms, breeders, or other agricultural partners with whom we work.

Unless otherwise stated in writing, all animals are sold as is and without ongoing warranty or guarantee after pickup, delivery, or transfer to the buyer’s care, custody, or control.

Once an animal has been picked up, delivered, or otherwise transferred to the buyer, Green Thumb Ranch is not responsible for sickness, injury, death, veterinary expenses, transport-related stress, loss, damages, or other issues arising after the transfer.

It is the buyer’s responsibility to inspect the animal before purchase or transfer and to provide proper transportation, housing, food, water, fencing, quarantine if appropriate, handling, supervision, and veterinary care.

Any statements regarding breed, age, sex, condition, temperament, health, or productivity are made to the best of our knowledge at the time of sale, but no continuing warranty is made unless expressly set forth in writing signed by us.

12. Farm Rules, Minors, and Assumption of Risk

A farm is an active agricultural environment. By entering the property or participating in any activity, you acknowledge that risks exist, including uneven ground, mud, holes, insects, weather, plants, equipment, fencing, gates, animal behavior, animal contact, allergens, and other visible or hidden hazards.

You agree to follow all posted signs, staff instructions, safety rules, animal-handling rules, and restricted-area directions.

Children must remain under the direct supervision of a parent or legal guardian at all times.

You may not feed, chase, handle, ride, open gates for, or otherwise interact with animals unless expressly allowed by Green Thumb Ranch staff.

We reserve the right to refuse entry, remove any person, or end any activity without refund if we believe a person is acting unsafely, disrupting others, mistreating animals, ignoring instructions, or creating a risk to people, animals, or property.

13. Florida Agritourism Warning and Notice of Risk

Green Thumb Ranch intends to rely on the protections available under Sections 570.88 and 570.89, Florida Statutes, for qualifying agritourism activities. Under Florida law, an agritourism operator’s limitation of liability applies only if the required statutory notice is posted as required, and the statute does not protect against gross negligence, willful or wanton disregard for safety, or intentional injury.

The following warning is included here as part of these Terms and should also be used where required by Florida law:

WARNING

Under Florida law, an agritourism operator is not liable for injury or death of, or damage or loss to, a participant in an agritourism activity conducted at this agritourism location if such injury, death, damage, or loss results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury, death, damage, or loss. You are assuming the risk of participating in this agritourism activity.

By entering the property or participating in any farm visit, event, or agritourism activity, you acknowledge this warning and assume the inherent risks of participation to the fullest extent permitted by Florida law.

14. Photography and Video Release

By visiting Green Thumb Ranch, attending an event, participating in an activity, or entering our property, you grant Green Thumb Ranch and its representatives permission to photograph, video record, and otherwise capture your image, likeness, voice, and presence, as well as those of members of your group, while on our property or participating in events or activities.

You agree that such photos, videos, and recordings may be used for lawful promotional, marketing, advertising, editorial, and business purposes, including on our website, social media pages, digital advertisements, printed materials, and third-party promotional channels, without compensation, further notice, or additional consent.

If you do not want to appear in photos or videos, you must notify us before or upon arrival. While we may try to accommodate such requests, we cannot guarantee that you or members of your group will not appear incidentally in background or crowd images.

A parent or legal guardian is responsible for notifying us regarding any minor child in their group.

15. Health, Allergy, and Animal Contact Disclosures

Some products and activities may involve allergens, food products, dust, hay, plants, insects, and animal contact. You accept responsibility for determining whether participation or purchase is appropriate for you or your group.

Except as required by law, Green Thumb Ranch is not liable for allergic reactions, sensitivities, illness, or injuries arising from undisclosed conditions, improper handling, improper storage, failure to follow instructions, or ordinary exposure associated with farm environments and products.

16. Intellectual Property

All content on the Site, including text, graphics, logos, photos, videos, branding, designs, and other materials, is owned by or licensed to Green Thumb Ranch and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, republish, display, or exploit Site content without our prior written permission, except for normal personal, non-commercial use.

17. Third-Party Links and Services

The Site may contain links to third-party websites, payment processors, ecommerce tools, social media platforms, or other external services. We do not control and are not responsible for third-party content, products, services, or privacy practices.

18. Disclaimer of Warranties

To the fullest extent permitted by law, the Site, all products, all services, all bookings, all events, all visits, all animals, and all content are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Green Thumb Ranch disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and uninterrupted use.

19. Limitation of Liability

To the fullest extent permitted by law, Green Thumb Ranch and its owners, affiliates, officers, employees, agents, contractors, volunteers, partners, and representatives are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, animals, crops, plants, property, or opportunity arising out of or relating to the Site, any purchase, any booking, any event, any farm visit, any animal, any product, or these Terms.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to your interaction with Green Thumb Ranch will not exceed the amount you paid us for the specific product, service, booking, or event giving rise to the claim.

Nothing in these Terms limits liability to the extent such limitation is prohibited by law.

20. Indemnification

You agree to indemnify, defend, and hold harmless Green Thumb Ranch and its owners, affiliates, officers, employees, agents, contractors, volunteers, partners, and representatives from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the Site, your breach of these Terms, your conduct on the property, your participation in activities, your handling of products or animals, or your violation of law or the rights of a third party.

21. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules.

Any dispute arising out of or relating to these Terms, the Site, or your dealings with Green Thumb Ranch shall be brought in the appropriate state or federal court located in Florida, unless applicable law requires otherwise, and you consent to the jurisdiction of those courts.

22. Changes to These Terms

We may update these Terms from time to time. Updated Terms become effective when posted on the Site unless otherwise stated. Your continued use of the Site or continued dealings with Green Thumb Ranch after updated Terms are posted constitutes your acceptance of the revised Terms.
